Mail Ban: How This Crisis Will Effect the Cannabis Vaping Industry
As reported today by MJ BIZ, the USPS is postponing their enforcement of the mail ban going into effect on vaping products to give it more time to study the new law. Vaping is one of the most preferable ways of consuming cannabis. Especially when the user does not want to feel the scorching and drying effect noticed in the mouth and throat whenever the pot is smoked.
For patients with chronic illnesses, vape pens provide the ideal means to derive quick relief from pains without any risk of having lung inflammation or worsening their symptoms.
The traditional method of flame-to-flower combinations, that is smoking, has a lot of risk factors attached. Vaping on the other hand heats the plant—zero combustion.
It is too bad that the government has decided to ban vape mails. Late December 2021, Congress stylishly inferred a vape mail ban when it approved the consolidated appropriations act of 2021.
They termed it "Preventing Online Sales of E-Cigarettes to Children Act".
It was unexpected.
Reason for the Mail Ban
This new act just classifies the online sales of e-cigarettes under the same limitations that have been in place for cigarettes and tobacco products.
The government has caught wind of the way underage youths purchase e-cigarettes online. While we can all agree that we don't want children vaping, we can also argue that the government could have gone through other ways to keep these products out of their hands. The added vape mail ban might not accomplish much.
This act restricts the United States Postal Service (USPS), as well as the Electronic Nicotine Delivery Systems (ENDS) from delivering or posting out cigarettes to all customers, regardless of the customer's age.
This affects not only the children but also adults using these e-cigarettes for either recreational or medicinal uses.
The act is conveniently wide and extensive.
It affects many folks. Some say the problem with this act is its wording.
The act classifies all electronic devices— that deliver flavor, nicotine, or any other substance through an aerosolized solution to the user when it is inhaled from the device— under ENDS.
The acts seem too vague. Several devices do this. From vapes to wax devices. Even aromatherapy products can be in this form.
With the way the bill is phrased, any component of this electricity device falls under the ACT.
By the start of summer, this new regulation will be effected in the cannabis industry. Several businesses might come tumbling down because this is going to affect the sales of legitimate companies in the industry.
Congress probably included the text in that bill because the senators knew there was going to be a lot of public outrage if it was done separately. In late December, the media was focused on other things, it missed this bill.
Oddly enough, the new regulation did not list marijuana on any of its pages, but with the way it is worded, the marijuana industry must be ready to conform to the new law.
Anyone in the industry selling vape pens and their other products is affected by this law.
Simply put, this new regulation might wreck a lot of companies and leave its employees jobless or with reduced pay.
Postal services like FedEx and UPS have accepted the regulations and have put a stop to shipping products that fall under ENDS within or from the United States of America.
Effects of the Vape Mail Ban on the Industry
The vaping market is facing a technical crisis now that all vaporizing devices are categorized as nicotine products.
All vape manufacturers and retailers are to follow the guidelines listed in the Prevent All Cigarette Trafficking Act.
Some of these guidelines include:
-
All vaping companies must register with the Attorney General's office.
-
The age of all customers must be ascertained.
-
All accumulated taxes are to be paid to the right channels.
-
Proper documentation of the business expenditure.
-
If a buyer violates the PACT Act, it must be recorded in detail.
-
Strict penalties for defaulting companies. Including time in prison.
The aftermath of this ban include:
A rise in Black Market products
Once customers are unable to get their vaping products through the legal channels, they'll be forced to find sources in the black market.
The black market shouldn't exist in any industry, but with this act, the vaping products black market would emerge in full force.
Increase in Price of Vaping Products
With this bill, there would be a shortage of quality vaping products in the market. So an increase in price will occur—as this is the next response when demand is higher than supply in any industry
Medical Patients would have no access to their medicine
Here, it is either they have to risk their already declining health by using low-quality products or they remain without them.
The market will also be flooded with products from the black market, no one will be able to detect which makes are trustworthy. This is risky.
The systematic collapse of the legal vaping industry
The nicotine vaping industry is being attacked by this act. And it might spill into the cannabis vaping industry.
However, from all indications, some companies might be going down, while the rest will have a higher cost of running their operations.
The president of 02VAPE, Dana E. in a statement emphasized that the bill disguises their customers as tobacco-driven, nicotine addicts. She also stated that a lot of livelihood and businesses would be destroyed by this bill. The aftermath could be worse than the effects of the pandemic lockdown in 2020.
How To Deal With The Mail Ban
-
All brick and mortar nicotine establishment must procure a tobacco product license.
-
Ship through private organizations.
-
Increase your customer's shipping fees, to prevent your company from bearing the full cost.
Bottom Line
As these companies struggle in the next months to deliver to their customers, you should purchase all the baking products you might need now. It would be harder and more expensive as the months go by.
Steps are also being taken to appeal the act and cajole the Congress to modify the text by leaving personal vaporizers for non-nicotine use out. All entrepreneurs in the vaping community are coming together to form a coalition.
The next few months might be promising, but we'll see how it goes.
